Since 2011, spouses in Latvia have had the opportunity to dissolve a marriage not only through the court, but also through a sworn notary. This procedure is suitable for those who want to resolve the issue quickly and without unnecessary hassle.<\/p>\n\n

One can get a divorce at a notary if:<\/p>\n\n

\u2022 both spouses agree to the divorce;
\u2022 there are no property disputes (or they have been settled in advance);
\u2022 the issue of child support and their place of residence has been resolved.<\/p>\n\n

If at least one of these points causes disagreement, the divorce is formalized only through the court.<\/p>\n\n

How the procedure works<\/strong><\/p>\n\n

The spouses sign a joint application at a notary. After submitting the application to the notary, there is a mandatory one-month \u201ccooling-off period\u201d. If the spouses have not changed their minds, after a month the notary formalizes the dissolution of the marriage and issues a divorce certificate in the form of a notarial deed.<\/p>\n\n

If one of the spouses is a foreigner<\/strong><\/p>\n\n

Often one of the spouses is a foreign citizen who cannot or does not want to come to Latvia to finalize the divorce. In such cases, a lawyer can represent their interests by power of attorney. This eliminates the need for a personal visit to the notary and makes the procedure as convenient as possible.<\/p>\n\n

It may also be the case that the second spouse – a citizen of Latvia – also lives abroad and is reluctant to come to Latvia specifically to sign the application with a notary. In this case, the second spouse can also be represented by power of attorney, but on the condition that this person has a declared place of residence in Latvia.<\/p>\n\n
