Saska\u0146\u0101 ar likumdev\u0113ja sniegto anot\u0101ciju groz\u012bjumu m\u0113r\u0137is \u2013 nodro\u0161in\u0101t efekt\u012bv\u0101ku nos\u016bt\u012bto darbinieku ties\u012bbu aizsardz\u012bbu, \u0146emot v\u0113r\u0101 Eiropas Parlamenta un Padomes pie\u0146emto direkt\u012bvu (ES) 2018\/957 un (ES) 2019\/1152 pras\u012bbas.<\/p>\n\n<p>Jaunie groz\u012bjumi skar tos Darba likuma pantus, kas regul\u0113 darba tiesisk\u0101s attiec\u012bbas ar darbiniekiem, kuri ierodas str\u0101d\u0101t Latvij\u0101, k\u0101 ar\u012b ar Latvijas darbiniekiem, kurus darba dev\u0113js nos\u016bta str\u0101d\u0101t uz cit\u0101m Eiropas Savien\u012bbas vai Eiropas Ekonomikas zonas valst\u012bm.<\/p>\n\n<p>Ja run\u0101jam par darbiniekiem, kuri no Latvijas tiek nos\u016bt\u012bti str\u0101d\u0101t uz cit\u0101m Eiropas Savien\u012bbas vai Eiropas Ekonomikas zonas valst\u012bm, iepriek\u0161 min\u0113tie groz\u012bjumi paredz, ka darba dev\u0113jam ir pien\u0101kums rakstveid\u0101 inform\u0113t darbinieku par:<br>1) valsti vai valst\u012bm, kur\u0101s paredz\u0113ts veikt darbu, un paredzamo darba veik\u0161anas ilgumu;<br>2) val\u016btu, k\u0101d\u0101 izmaks\u0101s darba samaksu;<br>3) naudas pabalstiem vai pabalstiem nat\u016br\u0101 saist\u012bb\u0101 ar darba uzdevumiem, ja t\u0101di tiek nodro\u0161in\u0101ti;<br>4) repatri\u0101cijas iesp\u0113ju un t\u0101s k\u0101rt\u012bbu, ja t\u0101 tiek nodro\u0161in\u0101ta;<br>5) darba samaksu, kas darbiniekam pien\u0101kas saska\u0146\u0101 ar t\u0101s valsts normat\u012bvo regul\u0113jumu, kur\u0101 vi\u0146\u0161 veiks darbu;<br>6) atl\u012bdz\u012bbu, kas saist\u012bta ar darbinieka nos\u016bt\u012b\u0161anu, un k\u0101rt\u012bbu, k\u0101d\u0101 tiek kompens\u0113ti izdevumi par ce\u013cu, \u0113din\u0101\u0161anu un izmitin\u0101\u0161anu;<br>7) t\u0101s valsts, kur\u0101 tiks veikts darbs, vienoto ofici\u0101lo t\u012bmek\u013cvietni, kur ietverta inform\u0101cija par darbinieku nos\u016bt\u012b\u0161anu.<\/p>\n\n<p>Turkl\u0101t, nos\u016btot darbinieku veikt darbu cit\u0101 Eiropas Savien\u012bbas dal\u012bbvalst\u012b vai Eiropas Ekonomikas zonas valst\u012b, attiec\u012bgi piem\u0113rojami normat\u012bvie akti, kas regul\u0113 ar komand\u0113jumiem saist\u012bto izdevumu atl\u012bdzin\u0101\u0161anu. Tagad darba dev\u0113js nos\u016bt\u012btajam darbiniekam izmaks\u0101 komand\u0113juma dienas naudu 30 procentu apm\u0113r\u0101 no komand\u0113juma dienas naudas normas, kas noteikta normat\u012bvajos aktos, kuri regul\u0113 ar komand\u0113jumiem saist\u012bto izdevumu atl\u012bdzin\u0101\u0161anu.<\/p>\n\n<p>Tom\u0113r darba dev\u0113jam nav pien\u0101kuma nos\u016bt\u012btajam darbiniekam izmaks\u0101t Darba likuma jaunajos noteikumos paredz\u0113to komand\u0113juma dienas naudu, ja ir sp\u0113k\u0101 viens no \u0161\u0101diem nosac\u012bjumiem:<br>1) darbiniekam tiek nodro\u0161in\u0101ta \u0113din\u0101\u0161ana tr\u012bs reizes dien\u0101;<br>2) darbiniekam izmaks\u0101jam\u0101 darba samaksa ir t\u0101da pati k\u0101 sal\u012bdzin\u0101mam darbiniekam valst\u012b, uz kuru darbinieks ir nos\u016bt\u012bts veikt darbu.<\/p>\n\n<p>Citiem v\u0101rdiem sakot:<\/p>\n\n<ul><li>ja komand\u0113jum\u0101 nos\u016bt\u012btajam darbiniekam tiks maks\u0101ta minim\u0101l\u0101 stundas likme, kas noteikta attiec\u012bgajai profesijai\/amatam valst\u012b, kur\u0101 darbinieks tiek nos\u016bt\u012bts veikt darbu, darba dev\u0113jam b\u016bs pien\u0101kums maks\u0101t darbiniekam 30 procentus no komand\u0113juma dienas naudas, kas noteikta \u0161\u012bs valsts normat\u012bvajos aktos;<\/li><li>ja komand\u0113jum\u0101 nos\u016bt\u012btajam darbiniekam tiks maks\u0101ta vid\u0113j\u0101 stundas likme, kas noteikta attiec\u012bgajai profesijai\/amatam valst\u012b, kur\u0101 darbinieks tiek nos\u016bt\u012bts veikt darbu, un plus darbiniekam tiks nodro\u0161in\u0101ta \u0113din\u0101\u0161ana tr\u012bs reizes dien\u0101 uz darba dev\u0113ja r\u0113\u0137ina, tad darba dev\u0113jam ir ties\u012bbas nemaks\u0101t \u0161\u0101dam darbiniekam komand\u0113juma dienas naudu.<\/li><\/ul>\n\n<blockquote class=\"wp-block-quote\"><p>T\u0101pat jaunie Darba likuma noteikumi uzsver: ja darba dev\u0113js atbilsto\u0161i likumam izmaks\u0101 darbiniekam komand\u0113juma dienas naudu, t\u0101 jebkur\u0101 gad\u012bjum\u0101 uzskat\u0101ma par izdevumu kompens\u0101ciju, bet ne darba samaksas da\u013cu.<\/p><\/blockquote>\n\n<p>V\u0113l viens svar\u012bgs jaunin\u0101jums: turpm\u0101k persona, kas sniedz pakalpojumu, lai nodro\u0161in\u0101tu \u0101rvalstu darbinieku nodarbin\u0101t\u012bbu Latvij\u0101 (piem\u0113ram, nodarbin\u0101t\u012bbas a\u0123ent\u016bra), ir uzskat\u0101ma par darba dev\u0113ju, kas nos\u016bta darbinieku veikt darbu Latvij\u0101. Uz personu, kas sniedz darbasp\u0113ka nodro\u0161in\u0101\u0161anas pakalpojumu \u0161aj\u0101 situ\u0101cij\u0101 attiecas visi darbinieka nos\u016bt\u012b\u0161anas noteikumi. T\u0101d\u0113j\u0101di likumdev\u0113js uzlika atbild\u012bbu par likumdo\u0161anas normu iev\u0113ro\u0161anu attiec\u012bb\u0101 uz personu, kas tiek nos\u016bt\u012bta uz Latviju veikt darbu ne tikai uz darba dev\u0113ju, bet ar\u012b uz starpnieku, ar kura starpniec\u012bbu darbinieku nodarbin\u0101ja Latvijas darba dev\u0113js.<\/p>\n\n<p>Jauni groz\u012bjumi Darba likum\u0101 var negat\u012bvi ietekm\u0113t pagaidu nodarbin\u0101t\u012bbas a\u0123ent\u016bras, k\u0101 ar\u012b Latvijas b\u016bvniec\u012bbas uz\u0146\u0113mumus, kas sniedz pakalpojumus \u0101rzem\u0113s. Nav nosl\u0113pums, ka tie\u0161i komand\u0113juma dienas naudas, kas past\u0101v vis\u0101s Austrumeiropas valst\u012bs, sniedza zin\u0101mas priek\u0161roc\u012bbas to darbiniekiem, nos\u016btot tos uz Vec\u0101s Eiropas valst\u012bm.
