KS b\u016bt\u012bba ir biedru kooper\u0113\u0161an\u0101s kop\u012bgo ekonomisko intere\u0161u realiz\u0101cijai.&nbsp;&nbsp;<\/p>\n\n<p>KS ir atv\u0113rta organiz\u0101cija, kas noz\u012bm\u0113 to, ka taj\u0101 var iest\u0101ties ikviena persona, kas v\u0113las sa\u0146emt KS sniegtos pakalpojumus un ap\u0146emas pild\u012bt biedra pien\u0101kumus.&nbsp;<\/p>\n\n<p>KS raksturo demokr\u0101tisk\u0101 p\u0101rvalde. Katram biedram neatkar\u012bgi no veikt\u0101 ieguld\u012bjuma KS pamatkapit\u0101l\u0101 (paju skaita) biedru kopsapulc\u0113 ir viena balss. Ar\u012b gad\u012bjum\u0101, ja biedru kopsapulci aizst\u0101j p\u0101rst\u0101vju sapulce, biedri saglab\u0101 savu kontroli KS p\u0101rvald\u012bb\u0101, iece\u013cot un atce\u013cot p\u0101rst\u0101vjus.&nbsp;<\/p>\n\n<p>KS past\u0101v biedru ekonomisk\u0101s l\u012bdzdal\u012bbas princips, paredzot ties\u012bbas un pien\u0101kumus apmaks\u0101t KS pamatkapit\u0101lu, segt KS izdevumus un zaud\u0113jumus.&nbsp;<\/p>\n\n<p>Sakar\u0101 ar to, ka iepriek\u0161\u0113jais, v\u0113l 1998.gad\u0101 pie\u0146emtais, Kooperat\u012bvo sabiedr\u012bbu likums (turpm\u0101k \u2013 Vecais likums), ir mor\u0101li novecojis, Tieslietu ministrija izstr\u0101d\u0101ja jauno normat\u012bvo aktu, kur\u0101 ietilpst vair\u0101kas izmai\u0146as, gan b\u016btisk\u0101s, gan tehnisk\u0101s.&nbsp;<\/p>\n\n<h2>Pamata at\u0161\u0137ir\u012bbas:&nbsp;<\/h2>\n\n<ul><li>neviena KS vairs nav komersants. Tom\u0113r, attiec\u012bb\u0101 uz komercnosl\u0113pumu, uz\u0146\u0113mumu un fili\u0101li, prok\u016bru un parasto komercpilnvaru piem\u0113ro Komerclikuma noteikumus.&nbsp;<\/li><li>vairs nav paredz\u0113ts KS veidu iedal\u012bjumus p\u0113c nozar\u0113m. T\u0101d\u0113j\u0101di, likums nosaka vien\u0101das pras\u012bbas vis\u0101m KS. \u013boti lo\u0123iski, jo, piem\u0113ram, Komerclikum\u0101, Biedr\u012bbu un nodibin\u0101jumu likum\u0101, Arodbiedr\u012bbu likum\u0101 nav atsevi\u0161\u0137\u0101 regul\u0113juma&nbsp; atkar\u012bb\u0101 no ties\u012bbu subjekta darb\u012bbas jomas. Tom\u0113r, Jaunaj\u0101 likum\u0101 tika saglab\u0101ts Ministru kabineta pilnvarojums izdot Ministru kabineta noteikumus par atbalstu lauku att\u012bst\u012bbai un t\u0101 sa\u0146em\u0161anas krit\u0113rijiem.&nbsp;<\/li><li>atvieglota KS dibin\u0101\u0161anas k\u0101rt\u012bba: Jaunais likums vairs neprasa dibin\u0101\u0161anas sapulces sasauk\u0161anu, t\u0101d\u0113j\u0101di, Uz\u0146\u0113mumu re\u0123istr\u0101 vairs neiesniedz dibin\u0101\u0161anas sapulces protokolu. \u0145emot v\u0113r\u0101 to, ka visi KS dibin\u0101t\u0101ji (ne maz\u0101k k\u0101 tr\u012bs personas) paraksta dibin\u0101\u0161anas l\u012bgumu un stat\u016btus, dibin\u0101\u0161anas sapulces organiz\u0113\u0161ana bija lieka. L\u012bdz ar to likumprojekt\u0101 noteikts, ka p\u0113c groz\u012bjumu izdar\u012b\u0161anas KS dibin\u0101\u0161anas dokumentos, Uz\u0146\u0113mumu re\u0123istr\u0101 iesniedzams groz\u012bjumu teksts, k\u0101 ar\u012b pilns teksts jaunaj\u0101 redakcij\u0101.&nbsp;<\/p>\n\n<p>4) Vienlaic\u012bgi likumdev\u0113js palielin\u0101ja pras\u012bbas balsu skaitam, kam j\u0101balso par groz\u012bjumu izdar\u012b\u0161anu stat\u016btos, sabiedr\u012bbas darb\u012bbas izbeig\u0161anu vai turpin\u0101\u0161anu un sabiedr\u012bbas reorganiz\u0101ciju \u2013 ne maz\u0101k par trim ceturtda\u013c\u0101m kopsapulc\u0113 kl\u0101teso\u0161o biedru eso\u0161o divu tre\u0161da\u013cu viet\u0101.&nbsp;<\/p>\n\n<h2>Pamatkapit\u0101ls&nbsp;<\/h2>\n\n<ol><li>Saglab\u0101ts KS pamatkapit\u0101la main\u012bguma princips, jo KS ir br\u012bvpr\u0101t\u012bg\u0101 organiz\u0101cija, un personas ir ties\u012bgas br\u012bvi iest\u0101ties taj\u0101 un izst\u0101ties no t\u0101s, kas attiec\u012bgi rada izmai\u0146as KS pamatkapit\u0101l\u0101. Iev\u0113rojot to, ka KS raksturo demokr\u0101tisk\u0101 p\u0101rvald\u012b\u0161ana, un katram KS biedram ir tikai viena balss, nav nek\u0101da pamatojuma, k\u0101p\u0113c balssties\u012bbas b\u016btu j\u0101piesaista pie pajas kategorijas.&nbsp;&nbsp;<\/li><li>Saska\u0146\u0101 ar Veco likumu KS pamatkapit\u0101la minim\u0101lais lielums ir 2800 euro, bet&nbsp; dz\u012bvok\u013cu \u012bpa\u0161nieku kooperat\u012bvo sabiedr\u012bbu, automa\u0161\u012bnu gar\u0101\u017eu \u012bpa\u0161nieku kooperat\u012bvo sabiedr\u012bbu un citu KS veidu pamatkapit\u0101la minim\u0101lais lielums ir 280 euro. Jaunaj\u0101 likum\u0101 vairs nav normas, kura nosaka pamatkapit\u0101la minim\u0101lo summu, to nosaka KS biedri (dibin\u0101t\u0101ji). \u0160o summu ieraksta stat\u016btos tikai pa\u0161as KS un t\u0101s biedru intere\u0161u aizsardz\u012bbai, lai sekotu situ\u0101cijai, kad KS pa\u0161u kapit\u0101ls ir k\u013cuvis maz\u0101ks par KS stat\u016btos noteikto pamatkapit\u0101la minim\u0101lo apm\u0113ru. Tas kalpo par sava veida atskaites punktu, lai p\u0101rvaldes instit\u016bcijai iest\u0101tos pien\u0101kums veikt pas\u0101kumus, lai izvair\u012btos no KS ekonomisk\u0101s situ\u0101cijas pasliktin\u0101\u0161an\u0101s.&nbsp;<\/li><li>Tagad KS biedri var\u0113s apmaks\u0101t pamatkapit\u0101lu gan naud\u0101, gan ar mantisko ieguld\u012bjumu.
