I’ve given immovable property (an apartment) to my relative as a gift in 2005, but prior to that received a mortgage loan, which was secured by husband’s property. At the moment I’m unable to pay the loan, so probably the bank will sell the pledged property of my husband through auction. I’m afraid the money received from the sale of the pledged property won’t suffice to fully satisfy the debt, and the bank, knowing about the gift I made, will demand satisfaction of the debt from the apartment gifted to my relative. 27.01.2010 We would like to give an apartment as a gift to our daughter, who is 16 and wants to start living independently. According to the Land Register my husband is the only owner of the apartment. Is it true that a permission of the Orphan’s court is needed before we proceed with signing the gift agreement at a notary? 27.01.2010 The housing cooperative that is in charge of our house’s maintanance, every month in the bill indicates the penalty interest for late payment. I am not a member of this cooperative and have not signed any contracts. Can the cooperative charge me a penalty interest? 27.01.2010 My husband has huge problems with creditors. As in this case, how would it be better to secure our only property (the apartment) so that we are not evicted as a whole family? I heard that in such situations, many enter into prenup agreements. Is this so and what would be the procedure? 27.01.2010 I’m not satisfied with judgment of the court regarding the recovery of losses. How to file for an appeal? 27.01.2010 Is it true that a company can be protected from claims of the creditors for a period of one year upon court order? In what cases the procedure can be initiated? 27.01.2010 Is it possible to hold a person liable for rudeness, spam and incitement of hostility in the Internet space? 27.01.2010 Due to the fact that in the inheritance case there were reasonable doubts that the property could disappear from the deceased’s apartment, the notary advised us to invite a bailiff. Therefore, I have a question – what is really the bailiff’s function and what is the bailiff entitled to do? 27.01.2010 My wife and I gave our son a summer house as a gift. An Orphan’s court appointed me as a guardian until my son turns 18 years old. Does this impose any special obligations on me, or is custody in this case a pure formality? After all, it’s still my own son. 27.01.2010 It was repeatedly written in the press about conflicts with security in shopping centers that require them to go into the utility room and where they search your belongings. At the same time, it was repeatedly explained that the security does not even have the right to detain a person, and if strictly according to the law, in the case of a stubborn buyer, the guard can only run after him and exhort, hoping that the police will arrive in time. Is it so? How is the protection action qualified if they are still trying to physically stop the buyer, and how are the buyer actions qualified if he responds the same to this physical effect? Does this mean that if they grab my hand, I can rightfully put the grabber on the floor? 27.01.2010
