I was dismissed because of the coronavirus. Can I be reinstated and in what terms?

The state-declared Covid-19 virus emergency situation and measures to limit its spread do not justify termination of the employment contract at the initiative of the employer. In the event of an emergency situation, the Labour Law is in full force and effect, and the employee may only be dismissed in the cases provided for by law.

In the event that there was no legal basis for the dismissal or the dismissal was in breach of statutory procedures, the employee may bring an action for invalidation of the employer’s termination of the employment contract within one month of receiving the warning.

In other cases where the employee’s right to continue his or her employment is infringed, the employee may apply to the court for reinstatement within one month from the date of dismissal.
